What Is the Section 79 Claim Notice?

The Section 79 claim notice is the formal notice claiming the right to manage. Serving this notice starts the statutory RTM process.

The notice must include prescribed information set out in the RTM regulations. Missing or incorrect information gives the freeholder grounds to object.

Who Must Be Served?

The Section 79 claim notice must be served on:

• The freeholder (landlord)
• Any intermediate landlord
• The managing agent (if any)
• Any party who has notified the RTM company of their interest in the building

Failing to serve all relevant parties gives them grounds to object.

Prescribed Information

The claim notice must include:

• RTM company name and company number
• Correct building description
• Names of RTM company members
• Proposed acquisition date (at least 3 months from service)
• Statement that the building qualifies for RTM
